Committee to study theft of copper, bronze and other metals. Creates special joint committee to study the theft of certain precious metals for scrap and methods by which such thefts may be better deterred through increased documentation at the point of sale.

Senate amendment 2 provides the speakers with category suggestions for the five citizen representatives who will serve on the committee.

Real Estate Industry Legislation

Moving of existing residence from foundation. Restricts the movement of a single family residence from an existing foundation to another foundation within a developed area of single family residences. Requires home to be moved to be consistent with the age, value, size and appearance of existing residences within the developed area of single family residences. Also requires approval of home owners' association, regional planning commission, municipal planning commission, or local legislative body before this type of residence may be located within such developed area.
Amendments: House amendment 1 adds neighborhood associations that have been in existence for at least one year to those whose approval is required. House amendment 2 clarifies that "single family residence" as defined in the bill does not include manufactured or modular homes.

Registration and recording of documents electronically. Authorizes registration and recording of electronic documents by county registers. Specifies if a law requires, as a condition for recording, that a document be an original, be on paper, or be in writing, the requirement can be satisfied by an electronic document. Also specifies if a law requires, as a condition for recording, that a document be signed, the requirement can be satisfied by an electronic signature.
Amendments: Senate amendment 1 clarifies that an electronic document under this bill is a writing created or retained in an electronic record in accordance with the Uniform Electronic Transaction Act or the Uniform Real Property Electronic Reading Act and transmitted to the county register electronically, or a paper copy of such electronic record. Further clarifies that an electronic document also refers to a writing that is a digitized image of a paper document (electronic copy) that is transmitted to the county register electronically. Requires certification of an electronic document to be made by either a licensed attorney or the custodian of the electronic version of the document and the signature of such person to be acknowledged by a notary public.

Escrow held on real property contracts. Revises total contract amount to $860,000 from $500,000 for determination of whether a contract for the improvement of real property is subject to escrow requirements.
Amendments: House amendment 1 rewrites the bill. Deletes language revising contract amount for determination of whether a contract is subject to escrow requirements. Requires that "all interest," rather than "any interest," must be paid to contractor immediately upon completion of contract; requires that retainage on any construction contract not exceed five percent of the amount of such contract; requires owner to pay retainages within 90 days after the completion or substantial completion of the project; requires that prime contractor pay all retainages due any subcontractor within 10 days after receipt of such retainages from owner. Senate amendment 2 is a technical amendment which clarifies language in the provisions of this bill apply to project for work completed, whichever occurs first and the scope of the work and all terms and conditions covered by the contract.

Civil action against owner of nuisance property. Allows nonprofit corporation, an interested party or neighbor to bring a civil action against owner of building that is public nuisance for compliance with building codes. Authorizes courts to appoint receivers to abate public nuisance when owner will not do so.
Amendments: House amendment 1 adds to the definition of "receiver" a nonprofit corporation that has been certified as such by entity where building is located. Specifies points of verification to appear on certification for such a nonprofit. Allows nonprofits to bring civil suit against any owner in violation and provides that the court will take the necessary steps to inspect and rule on the issue of public nuisance within 30 days of receiving a complaint. Details the deadlines of court proceedings pursuant to this act. Changes the fee cap from $5,000 to not greater than ten percent of the total cost of the abatement or $25,000 to the receiver. Senate amendment 2 clarifies that this legislation applies to an unoccupied structure.

Liens on improvements to real property. Revises definition of "contract price" for purposes of liens on real property to include the amount agreed upon by the contracting parties for furnishing materials, machinery, equipment, services, overhead and profit, included in the contract, increased on diminished by the price of extras or breach of contract. Redefines "furnish materials" to include the supplying of tools. Changes language that refers to a house or structure being erected upon a lot or tract of land to instead say "any lot or tract of real property upon which an improvement has been made." Defines "improvement." Specifies that there shall be a lien upon any lot or tract of real property upon which an improvement has been made by a prime contractor and any remote contractor and that the lien is to secure the contract price. Establishes other procedures related to liens on improvements to real property (42 pp.).
Amendments: Senate amendment 1 provides that notice provisions do not apply when the prime contractor is also the owner of a property. House Amendment 3 requires that notice of a contract for an improvement made with a mortgagor must be sent by certified or registered mail; revises those circumstances under which there is a rebuttable presumption that service is complete to include "one business day after commercial, overnight delivery" instead of "date of delivery to a commercial delivery service."

Requires THDA to promptly certify the potential gross income from restricted rents for each owner to attach to its application for classification as affordable housing rental property.

Replaces provision under which licensed professionals with proof of errors and omissions insurance are exempt from bonding requirements for subsurface sewage disposal systems with exemption for all state licensed professional engineers or registered engineer interns. Limits applicability of bonding requirements for soil scientists, soil consultants, and percolation testers to persons whose approval has been suspended or revoked and later reinstated.
Amendments: House Conservation & Environment amendment 1 exempts state licensed engineers from performance bonds and letters of credit and leaves provisions regarding soil scientists as they currently stand in code.
